Independent Remuneration Board Privacy Notice
1. Why are you processing my personal information?
The Independent Remuneration Board’s (the Board) role is to make determinations as to salaries and pensions payable to Northern Ireland Assembly (the Assembly) members, also known as MLAs, as well as former members of the Northern Ireland Assembly. In order to carry out this function, there may be times when the Board processes personal information.
We may publish information provided to us by statutory consultees specified under section 11(5A)(b) of the Assembly Members (Independent Financial Review and Standards) Act (Northern Ireland) 2011, namely Members of the Assembly, the Commission, and the trustees of the Assembly Members’ Pension Scheme and any other persons the Board thinks appropriate. This may include information provided to us in a submission to a consultation, a survey response, correspondence or during meetings. Such publication will be on our website. Any information that is published on our website will remain in the public domain.
The Board is subject to specific objectives in terms of probity, accountability, value for money and securing an appropriate level of remuneration for Members. The Board will also ensure that its decisions and the reasons for those decisions are readily ascertainable and will enable members of the public to be informed about its activities. Before making a determination, the Board will publish a draft determination and consult on that draft with various organisations including members of the Assembly, the Northern Ireland Assembly Commission (the ‘Commission’) and any other persons the Board thinks appropriate.
The Board may also make a determination relation to pensions where it is of the opinion that it is reasonable and appropriate. A statement of reasons for that opinion will be communicated to the Commission.
The Board must also communicate each determination to the Commission which will then publish the determination in full.
Data protection legislation requires that any organisation which processes personal data must have a valid reason for doing so, known as the ‘lawful basis’ for processing.
For the purpose of this function, the Board will process your personal information to ensure transparency, accountability, and compliance with legal obligations and as the data controller of the information that you provide, the Board will ensure that the information is protected in accordance with Data Protection Legislation.
2. What is the lawful basis for processing my personal information?
Legal Obligation
Processing is necessary for compliance with legal obligations to which the controller is subject to pursuant to sections 47 and 48 of the 1998 Act.
Public Task
Processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the Assembly Commission pursuant to sections 47 and 48 of the 1998 Act.
Legitimate Interests
Processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject.
3. Where do you get my personal data from?
Personal data will be collected throughout the relationship with the Board, and may in certain circumstances, be shared with third parties with whom we have a relationship, but only where we have a lawful basis for doing so.
4. What categories of personal data are you processing?
The Board may process personal data which is any information which relates to an identified or identifiable natural person. This may include, name, age, date of birth, gender, etc.
5. Do you share my personal data with anyone else?
Personal data will be held in a secure network environment by the Board solely for the purpose of discharging its functions.
6. Do you transfer my personal data to other countries?
This data will not be transferred to other countries.
Should a transfer to another country be required by law, the transfer will only be made if that country or territory ensures an adequate level of protection for the rights and freedoms of data subjects in relation to the processing of personal data.
7. How long do you keep my personal data?
We will retain your data for a limited period in line with the Board’s Retention and Disposal Schedule.
8. What rights do I have?
- You have the right to obtain confirmation that your data is being processed, and access to your personal data
- You are entitled to have personal data rectified if it is inaccurate or incomplete.
- You have a right to have personal data erased and to prevent processing, in specific circumstances.
- You have the right to ‘block’ or suppress processing of personal data, in specific circumstances.
- You have the right to data portability, in specific circumstances.
- You have the right to object to the processing, in specific circumstances.
- You have rights in relation to automated decision making and profiling.
