Renewable Electricity Generation Bill

Closes 21 Oct 2026

Clause 10 - Supplier levy

Clause 10 allows the Department to make regulations to require electricity suppliers to pay a levy to the counterparty to cover the counterparty’s costs of making payments to electricity generators under Contracts for Difference including covering losses as a result of insolvency or supplier default.

The regulations will also allow the Department to specify (or not) that the levy can be based on the amount of electricity supplied or expected to be supplied. The regulations will also allow for the exemption of certain supplies where the electricity supplied will not be taken into account in the calculation of the levy.  The regulations will also allow the counterparty to seek financial collateral from suppliers.
