Clause 23: Removal of requirement to audit performance plans etc.

Clause 23 removes the requirement for the Comptroller and Auditor General to audit the Policing Board's performance plan and performance review, as required under section 29 of the Police (Northern Ireland) Act 2000.

This Clause is taken from a recommendation contained in a 2023 Northern Ireland Audit Office report that recommended aligning the process in Northern Ireland with England and Wales.

Removal of requirement to audit performance plans etc

23.—(1) In the Police (Northern Ireland) Act 2000 (“the 2000 Act”), omit section 29 (audit by Comptroller and Auditor General of performance plans and performance summary).

(2) In consequence of subsection (1), omit the following provisions⁠—

(a) in section 31(1) of the 2000 Act, the words “29(4) or (4A) or”;

(b) section 31(3) and (4) of that Act;

(d) in Schedule 3 to the Northern Ireland Act 1998 (Devolution of Policing and Justice Functions) Order 2010 (S.I. 2010/976), paragraphs 56 and 58(1)(c) and (d).
