Clause 4: Duties of a custody officer after charge

Clause 4 deals with the duties of a custody officer to take account of additional factors when deciding whether to release a child, either with or without bail.

4. In Article 39 of the Police and Criminal Evidence (Northern Ireland) Order 1989 (duties of custody officer after charge), in paragraph (2A)—

(a) omit the “and” at the end of sub-paragraph (c), and

(b) at the end of sub-paragraph (d) insert “; and

(e) in the case of an arrested juvenile—

  • (i) the juvenile’s age, maturity and needs;
  • (ii) the juvenile’s capacity to understand and comply with any condition of bail,”.
